1. Overview
- This policy explains how Tandem Learning Pty Ltd (ABN 29 689 284 473) collects, uses, stores, and discloses personal information through the Tandem Tutors platform, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
- Because many of our users are minors, we apply additional care to how we collect and use children's data, described in clause 7.
- Individuals also have a statutory right to sue for serious invasions of privacy under the Privacy and Other Legislation Amendment Act 2024 (Cth), separate to and in addition to any complaint made to us or to the OAIC.

2. What we collect
- Account information — name, email, date of birth, and (for Tutors) identity verification and Working with Children Check details
- Guardian information — where a user is under 18, the name and contact details of the parent or guardian who accepted these terms
- Profile information — subjects taught, qualifications, availability, rates (Tutors); year level, subjects studied (Students)
- Booking and lesson data — schedules, lesson notes, content covered, homework, assessment tracking
- Payment information — collected and processed as described in our Payments Terms; we retain transaction records but not full card details
- Communications— messages sent through the Platform's messaging feature
- Usage data — device information, log data, and analytics collected automatically when you use the Platform
3. How we use it
- To operate core features: matching, booking, live lessons, and CRM tools
- To process payments as described in our Payments Terms
- To verify Tutor identity and, where applicable, Working with Children status
- To communicate with you about your account, bookings, and policy changes
- To meet legal obligations, including responding to safety concerns involving minors
4. Automated decision-making
- The Platform uses an automated matching process to suggest Tutors to Students (and vice versa). This process uses profile information such as subject, year level, location, availability, and stated preferences to generate suggestions.
- This process can reasonably be expected to affect which Tutor a Student is connected with. It does not make final decisions on your behalf — Students and Tutors choose whether to proceed with any suggested match.

5. Who we share it with
- Tutors and Studentssee the information about each other necessary to conduct a lesson (name, subject, availability, lesson history). Tutors do not see Students' payment details.
- Stripe processes payments — see our Payments Terms for detail.
- We do not sell personal information. We do not share data with advertisers.
- We may disclose information where required by law, or where necessary to protect the safety of a minor.
6. Data storage and security
- Data is stored on servers located in Australia, with appropriate encryption in transit and at rest.
- Access to personal information is restricted to staff and systems that need it to operate the Platform.
- We retain account and lesson data for as long as the account is active, and for a reasonable period after closure to meet legal and dispute-resolution obligations, after which it is deleted or de-identified.
7. Children's data
- Where a Student is under 18, we collect the minimum information necessary to provide the service and require guardian consent at signup.
- Guardians can request access to, correction of, or deletion of their child's data at any time by contacting us.
- We do not use children's data for any purpose beyond operating the Platform; we do not use it for targeted advertising.
- Tutors interacting with minors on the Platform are bound by the conduct obligations in our Terms of Service, and messaging between Tutors and Student accounts under 18 may be monitored for safety purposes.
- This policy will be reviewed and updated in line with the OAIC's Children's Online Privacy Code once registered.
8. Your rights
- You can access and correct your personal information through your account settings, or by contacting us.
- You can request a copy of the data we hold about you, or request deletion, subject to our legal retention obligations (e.g. financial records).
- If you're unhappy with how we've handled your information, you can lodge a complaint with us at admin@tandemlearning.com.au, with the Office of the Australian Information Commissioner (OAIC) if unresolved, or, for serious invasions of privacy, pursue a claim under the statutory tort in the Privacy Act 1988 (Cth).
9. Cookies and tracking
- We use cookies and similar technologies for login sessions, analytics, and platform functionality. We do not use third-party advertising cookies.
10. Changes to this policy
- We may update this policy from time to time. Material changes will be notified by email or in-platform notice before taking effect.
