1. Who these terms apply to
- These terms govern use of the Tandem Tutors platform (“the Platform”), operated by Tandem Learning Pty Ltd, ABN 29 689 284 473 (“Tandem”, “we”, “us”).
- The Platform is used by two groups of users: Students (including parents/guardians acting on their behalf) and Tutors.
- By creating an account or using the Platform, you agree to these terms. If you're under 18, a parent or guardian must accept these terms on your behalf and is responsible for your use of the Platform.
2. Accounts and eligibility
- You must provide accurate information when creating an account and keep it up to date.
- Users under 18 require a parent or guardian to hold or co-hold the account, consent to data collection, and be responsible for payment obligations.
- Tutors must be 18 or older and complete our verification process before listing on the marketplace or accepting students, including identity verification and, where the Tutor works with minors, a valid Working with Children Check (or state equivalent) and disclosure of any relevant conflicts of interest.
- We may suspend or reject any account at our discretion, including where verification checks fail or information is found to be false.
3. What the Platform does
- Tutor CRM — free tools for Tutors to manage their own students, including scheduling, lesson notes, availability, and billing for students the Tutor brings independently of the marketplace.
- Marketplace — a matching service connecting Students with Tutors, including profiles, messaging, booking, and payments. Matching suggestions are generated by an automated process that uses information such as subject, year level, location, availability, and stated preferences. - Live Lessons — video lessons conducted on-platform.
- We may add, change, or remove features at any time. Core functionality (the free Tutor CRM) will not be paywalled without reasonable notice.
4. Payments
- All fees, marketplace markups, deposits, refunds, and payment processing are governed by our Payments Terms, which form part of these Terms of Service by reference.
- Where the Payments Terms conflict with anything in this document on a payments matter, the Payments Terms take precedence.
- The Payments Terms may be updated separately to this document, on the notice period stated within them.
5. Live lessons and content
- Lessons conducted through the Live Lessons feature may be recorded for quality, safety, or dispute-resolution purposes. Both parties will be notified before recording begins.
- Lesson notes, homework, and progress records created through the Platform belong to the Student (or their guardian) and the Tutor jointly; both may access this history for as long as they hold an account.
6. Conduct
Users must not:
- Misrepresent their identity, qualifications, or Working with Children status
- Use the Platform to solicit or arrange contact with a minor outside the safety and communication features built into the Platform
- Circumvent marketplace fees, as described in the Payments Terms
- Upload content that is unlawful, infringing, or harmful
- Attempt to scrape, reverse-engineer, or interfere with the Platform's operation
We reserve the right to suspend or terminate accounts that breach this clause, and to report conduct involving harm to minors to the relevant authorities.
7. Liability
- The Platform facilitates connections between Students and Tutors but Tandem is not a party to the tutoring relationship itself. We do not guarantee tutoring outcomes.
- To the maximum extent permitted by the Australian Consumer Law, Tandem's liability for any claim arising from use of the Platform is limited to the fees paid to Tandem in the 12 months preceding the claim.
- Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law, or any right an individual has under the Privacy Act 1988 (Cth), including the statutory tort for serious invasions of privacy.
8. Termination
- You may close your account at any time. We may suspend or terminate accounts for breach of these terms, safety concerns, or fraudulent activity.
- Provisions relating to payment obligations, liability, and intellectual property survive termination.
9. Changes to these terms
- We may update these terms from time to time. Material changes will be notified by email or in-platform notice at least 14 days before taking effect.
- This does not apply to the Payments Terms, which are updated on their own notice period — see that document.
10. Governing law
- These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
